dc.description.abstractÖmer Menekşe’nin “Osmanlı’da Hırsızlık” çalışması genelde hukuk tarihi ve hukuk sosyolojisi özelde ise Osmanlı hukuk tarihine dair bir araştırmadır. Eser, Osmanlı döneminde hırsızlığa teşebbüs eden bireyleri caydırmaya ve kamu düzenini sağlamaya yönelik iktisadî ve sosyal tedbirleri incelemesi bakımından Osmanlı hukuk tarihi alanına katkı sağlayan bir çalışmadır. Bu çalışmada müellif geniş bir coğrafyaya yayılmış olan ve bünyesinde farklı ırk ve dinlerden birçok unsuru barındıran Osmanlı devletinde hırsızlık suçu ve cezasını, bu suça yol açan nedenleri ve alınan önleyici tedbirleri ele almış ve bu tedbirlerin söz konusu suçu engellemede ne derece başarılı olduğunu sergilemiştir.
dc.description.abstractÖmer Menekşe's study ‘Theft in the Ottoman Empire’ is a research on the history of law, the sociology of law in general, and the history of Ottoman law in particular. The work is a study that contributes to the field of Ottoman legal history by analyzing the economic and social measures aimed at deterring individuals who attempted theft in the Ottoman period and ensuring public order. In this study, the author examined the crime and punishment of theft in the Ottoman state, which spread over a wide geographical area and included many elements of different races and religions, the reasons that led to this crime and the preventive measures taken, and demonstrated how successful these measures were in preventing the crime in question.
